Definitions

Eligibility

To use the Bijlipaanitech App, you must:

1. Be at least 18 years of age, or have the consent of a parent or legal guardian if between 13-17 years old.
2. Have the legal capacity to enter into a binding agreement.
3. Not be barred from receiving our Services under applicable laws.
4. Provide accurate and complete information during registration.

Users under 13 years of age are not permitted to use the App. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.

Account Registration

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

You may not:

• Create an account for anyone other than yourself without permission
• Use another person's account without authorization
• Create more than one personal account
• Transfer your account to anyone without our written permission

App License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to:

1. Download and install the App on mobile devices that you own or control
2. Use the App for your personal, non-commercial use
3. Access and use the Services as intended through the normal functionality of the App

This license does not permit you to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any proprietary notices or labels from the App
• Use the App for any commercial purpose without our express written consent
• Use the App in any manner that could damage, disable, overburden, or impair our Services

User Responsibilities

You agree not to use the App to:

• Violate any applicable law, regulation, or third-party rights
• Upload or transmit viruses, malware, or any other malicious code
• Engage in any fraudulent, deceptive, or illegal activities
• Harass, abuse, threaten, or harm other users
• Impersonate any person or entity, or falsely state your affiliation
• Interfere with or disrupt the integrity or performance of the App
• Attempt to gain unauthorized access to the App or related systems
• Use automated means (bots, scrapers, etc.) to access the App without permission

Data Accuracy

While we strive to provide accurate energy and water management insights, you acknowledge that:

1. The App provides estimates and suggestions based on algorithms and available data
2. Actual energy and water savings may vary based on numerous factors beyond our control
3. You should not rely solely on the App's recommendations for critical decisions
4. You are responsible for verifying billing and consumption data with your utility providers
5. We are not responsible for errors in data provided by third-party sources (weather data, utility APIs, etc.)

Subscriptions & Payments

Free and Premium Services

Bijlipaanitech may offer both free and premium (paid) features. Premium features require payment of subscription fees.

Subscription Terms

• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• Your subscription will automatically renew unless canceled before the renewal date
• You may cancel your subscription at any time through your device's app store settings
• Cancellation will take effect at the end of the current billing period
• No refunds are provided for partial subscription periods

Price Changes

We reserve the right to change subscription fees at any time. We will provide notice of price changes at least 30 days in advance. Continued use of the Service after a price change constitutes your agreement to pay the new price.

Third-Party Payment Processors

All payments are processed through third-party payment processors (Google Play Store, Apple App Store). You agree to their terms and conditions, and we are not responsible for any payment processing errors.

Intellectual Property

All rights, title, and interest in and to the App and Services, including all intellectual property rights, are and will remain the exclusive property of Bijlipaanitech and its licensors.

Our Content

The App, its features, functionality, design, logos, trademarks, and all content (except User Content) are protected by copyright, trademark, and other laws. You may not use our trademarks or logos without our prior written consent.

User Content

You retain ownership of any data you upload to the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display your User Content solely to provide the Services to you.

Feedback

If you provide us with feedback, suggestions, or ideas about the App, you agree that we can use them without compensation or obligation to you.

Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

You acknowledge that the App processes sensitive information including:

• Utility consumption data
• Billing information
• Location data (with your permission)
• Property information

We implement security measures to protect this data, but cannot guarantee absolute security.

Third-Party Services

The App may integrate with or provide links to third-party services, including:

• Utility company APIs for data import
• Weather data services
• Payment processors
• Smart home device platforms

These third-party services have their own terms and privacy policies. We are not responsible for:

1. The content or practices of third-party services
2. Any loss or damage caused by third-party services
3. Your interactions with third-party services

You use third-party services at your own risk.

Disclaimers

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES THAT THE APP'S RESULTS WILL BE ACCURATE OR RELIABLE
• WARRANTIES THAT ANY DEFECTS IN THE APP WILL BE CORRECTED
• WARRANTIES REGARDING THE ACCURACY OF ENERGY SAVINGS PREDICTIONS OR BILL ESTIMATES

We do not warrant that the App will meet your requirements or that its operation will be uninterrupted or error-free.

Limitation of Liability

1. Your use or inability to use the App
2. Any unauthorized access to or use of our servers and/or any personal information
3. Any interruption or cessation of transmission to or from the App
4. Any bugs, viruses, or similar that may be transmitted through the App
5. Any errors or omissions in any content, or for any loss or damage incurred as a result of using any content
6. Your reliance on energy or water savings suggestions provided by the App

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Bijlipaanitech and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

1. Your access to or use of the App
2. Your violation of these Terms
3. Your violation of any third-party right, including intellectual property or privacy rights
4. Any User Content you submit to the App
5. Your reliance on inaccurate data entered into the App

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, effective immediately.

Termination by You

You may stop using the App at any time. To delete your account, use the account deletion feature in the App settings.

Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• You must cease all use of the App and delete all copies of the App from your devices
• We may delete your account data in accordance with our Privacy Policy
• All provisions of these Terms which should survive termination shall survive, including ownership, warranties, disclaimers, indemnity, and limitations of liability

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.

If you are a consumer, you may benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by email at least 30 days before the changes take effect.

Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the App.

We encourage you to review these Terms periodically. The "Effective Date" at the top of this page indicates when these Terms were last updated.
